1. Agreement to Terms
By accessing or using the website of SoCal Pet Brace ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.
2. Services
SoCal Pet Brace provides custom orthotic and prosthetic devices directly to pet owners. Our services include:
- • In-person assessment, casting, and measurements
- • Custom fabrication of orthotic devices for animals
- • Custom fabrication of prosthetic devices for animals
- • Device fitting and delivery
- • Follow-up adjustments and support
- • Consultation and education for veterinary professionals
3. Professional Services
3.1 Service Provider: SoCal Pet Brace is not a veterinary medical provider. Dave Kou is a Certified Prosthetist-Orthotist (CPO) with a background in human rehabilitation medicine, not a licensed veterinarian. All orthotic and prosthetic services are provided under the recommendation or guidance of the pet's veterinarian. Veterinary medical decisions, including diagnosis and treatment plans, remain the responsibility of the pet owner's veterinarian.
3.2 Not Medical Advice: Information on our website is for informational purposes only and does not constitute veterinary medical advice. Always consult with your veterinarian regarding your pet's specific condition and treatment options.
3.3 Clinical Decisions: All decisions regarding the appropriateness of orthotic or prosthetic devices for your pet should be made in consultation with a licensed veterinarian.
3.4 Veterinary Relationship: We encourage all clients to maintain an active relationship with their veterinarian throughout the device process and to follow their veterinarian's recommendations regarding their pet's underlying condition.
4. Service Limitations and Disclaimers
4.1 No Guarantees: While we strive to provide high-quality devices and services, we cannot guarantee specific outcomes or that any device will resolve your pet's condition.
4.2 Individual Results: Each animal's response to orthotic or prosthetic devices may vary. Success depends on many factors including the pet's condition, proper fitting, consistent use, and owner compliance with care instructions.
4.3 Adaptation Period: Most pets require an adaptation period to become comfortable with a new device. We provide support during this period but cannot guarantee that all pets will successfully adapt.
5. Payment and Fees
5.1 Pricing: Pricing for devices and services is provided through direct consultation with our team. Prices may vary based on the type of device, complexity, and service model selected.
5.2 Payment Terms: Payment terms will be specified in your service agreement. Payment may be required before device fabrication begins or before fitting services are provided.
5.3 Insurance: While many pet insurance policies cover orthotic and prosthetic devices, coverage varies by provider and plan. We are not responsible for insurance reimbursements or coverage decisions.
6. Warranty and Returns
6.1 Device Warranty: All devices include a 30-day fit adjustment warranty from the date of delivery. This warranty covers fit adjustments and defects in materials or workmanship. It does not cover normal wear and tear or damage from misuse.
6.2 Modifications and Adjustments: Fit adjustments within 30 days of delivery are included at no additional charge.
6.3 Non-Refundable Deposit: The initial deposit is non-refundable. Because each device is custom-made for the individual patient, the deposit is forfeited upon cancellation regardless of fabrication status.
6.4 Custom Products: Due to the custom nature of our devices, refunds are generally not available once an order is placed. See our Warranty & Refund Policy for full details.
7. Limitation of Liability
To the fullest extent permitted by law, SoCal Pet Brace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- • Your use or inability to use our services
- • Any conduct or content of any third party, including veterinary clinics
- • Unauthorized access, use, or alteration of your information
- • Any other matter relating to our services
8. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of SoCal Pet Brace or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. User Conduct
You agree not to:
- • Use our website for any unlawful purpose
- • Attempt to interfere with the proper functioning of our website
- • Impersonate any person or entity
- • Submit false or misleading information
- • Violate any applicable laws or regulations
10. Service Area
Our services are currently available to veterinary clinics and pet owners within Southern California, including Los Angeles County, Orange County, Inland Empire, and San Diego County. Services outside this area may be considered on a case-by-case basis.
11. Termination
We reserve the right to terminate or suspend your access to our website and services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Los Angeles County, California.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our website and services after any changes constitutes acceptance of the new Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
